U.S. Supreme Court has cleared Trump administration plan to list only biological gender “M” or “F” on all new passports, blocking lower-court orders to restore the “X” gender marker.
In an unsigned ruling, the justices said recording biological sex is a neutral historical fact, not discrimination. It also noted that the policy will remain in place while the case proceeds at the lower courts.
Meanwhile, the American Civil Liberties Union vows to fight on, calling the decision “heartbreaking” for transgender and nonbinary Americans.
