Justice James Omotosho of the Federal High Court in Abuja has dismissed a lawsuit challenging President Bola Tinubu’s declaration of emergency in Rivers State.
The plaintiffs, Belema Briggs and four others, lacked the legal standing to bring the case, as they were not members of relevant authorities and did not have the Attorney General’s approval. The court upheld that the emergency was justified in preventing law and order breakdown, and the allegations of rights violations were unfounded since the President acted under proper legal authority.
The judge further described the suit as frivolous and baseless, noting the plaintiffs did not seek the consent of Rivers’ citizens. Prior these reactions, President Bola Tinubu had declared a state of emergency in March, citing political instability and attacks on oil infrastructure as reasons, and appointed an administrator to oversee the state.
